These Terms and Conditions ("Terms") govern your use of kennedyrolloff.com (the "Site") and the rental services provided by Kennedy Septic Services, doing business as Kennedy Roll-Offs ("we," "us," or "our"). By using the Site or renting from us, you agree to these Terms.
Services
We rent roll-off dumpsters in 12, 20, and 30 yard sizes and portable toilets for construction sites and events in Clarksville, Montgomery County, and the surrounding area. We do not provide junk removal, front-load or permanent waste service, or service in Nashville.
Eligibility
You must be at least 18 and able to enter into a contract to rent from us. By placing an order you represent that you meet these requirements.
Quotes, pricing, and payment
Prices are quoted as starting prices for the size, service, and address requested. Every roll-off rental includes 30 days; additional days are $10 per day. Landfill surcharges for tires, mattresses, and appliances are passed through at cost. We never mark them up. Additional charges may apply for prohibited materials, damage beyond normal use, relocation, or a blocked pickup.
Delivery, placement, and access
You are responsible for a safe, level, accessible placement spot with adequate overhead clearance and a lane the truck can use for delivery, service, and pickup. You are responsible for any permit required for placement on public property. We are not liable for pre-existing cracks, weak pavement, sealcoat, or other surface conditions beyond our reasonable control, or for damage that results from a placement you directed.
Rental period and pickup
The roll-off rental period begins on delivery and includes 30 days. Call dispatch to schedule pickup or a swap. Days beyond the included period are billed at $10 per day. Portable toilet rental and service terms are set in your quote.
Loading and prohibited materials
Do not load above the top rail of the box. Hazardous waste, liquids, batteries, propane tanks, medical waste, contaminated soil, and other materials the landfill refuses are prohibited and will result in additional charges. Tires, mattresses, and appliances carry landfill surcharges passed through at cost. Ask dispatch before loading anything unusual.
Cancellations and changes
Contact dispatch to change or cancel a scheduled delivery.
Damage and liability
You are responsible for the equipment while it is in your possession and for damage beyond normal wear. To the fullest extent permitted by law, our liability for any claim arising from our services is limited to the amount you paid for the rental in question, and we are not liable for indirect, incidental, consequential, or punitive damages.
Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses, including reasonable attorney fees, arising from your use of our equipment, improper loading, prohibited materials, or a violation of these Terms.

Governing law and venue
These Terms are governed by the laws of the State of Tennessee. Any dispute arising from these Terms or our services will be resolved in the state or federal courts located in Montgomery County, Tennessee.
Electronic agreements
Electronic signatures, acceptance by text or email, and quote confirmations are valid and binding under the Tennessee Uniform Electronic Transactions Act.
Changes
We may update these Terms. The date at the top is the most recent revision. Continued use of our services after a change means you accept the updated Terms.
