Terms of Service

These Terms of Service govern your use of the Kennedy Roll-Offs website and any quote, scheduling, delivery, swap, or pickup services for roll-off dumpsters. By using this site or booking service, you agree to these terms.

Operator summary: Provide accurate job details, keep access clear, load safely, and avoid prohibited items. We’ll coordinate delivery, swaps, and pickup based on routing and availability.

1) Definitions

“We,” “us,” and “our” refers to Kennedy Roll-Offs. “You” and “customer” refers to the person or entity requesting a quote, booking service, or using this website. “Dumpster” refers to roll-off containers (12, 20, or 30-yard sizes).


2) Quotes and Pricing

Quotes are based on the information you provide (job address, debris type, size, access, timing, and expected volume/weight). Pricing may include a base rental rate and any applicable additions such as extra days, over-tonnage, transport fees for locations outside core coverage, or landfill surcharges passed through at cost when they apply.

If your site conditions or contents differ from what was described, charges and scheduling may change to reflect actual conditions.


3) Scheduling, Delivery Windows, and Availability

Delivery, swap, and pickup timing is coordinated through dispatch and depends on routing, access, weather, traffic, landfill conditions, and equipment availability. Any stated timing is a scheduled window, not a guaranteed arrival time.

Same-day or expedited requests may be available depending on capacity. If you have a hard constraint (inspection, concrete pour, crane day), tell us during booking so we can plan appropriately.


4) Service Area Limitations

We provide roll-off dumpster service in Clarksville, TN and adjacent communities that touch Clarksville, plus the I-24 corridor toward Ashland City and Springfield. We do not provide dumpster service in Nashville, TN.


5) Site Access, Placement, and Customer Responsibilities

You are responsible for:

  • Providing a correct delivery address and accurate access instructions.
  • Ensuring safe truck access, clearance, and a suitable placement area (including overhead clearance and stable ground).
  • Securing any required permits or approvals for street/right-of-way placement if applicable.
  • Ensuring gates are unlocked and the drop zone is clear at the scheduled time.
  • Preventing others from moving, loading, or tampering with the dumpster without authorization.

If we cannot safely access or place the dumpster due to site conditions, a trip charge or rescheduling may apply.


6) Prohibited Materials and Loading Rules

You agree not to place prohibited materials in the dumpster. Prohibited items include hazardous waste, liquids, paints, oils, chemicals, batteries, and appliances containing refrigerants. Additional prohibited items may apply based on local landfill rules.

Loading must be level with the top rim and not heaped above the sides. Contents must allow doors to close and latch safely. Overfilled dumpsters may be refused for transport until corrected.


7) Landfill Surcharges and Special Items

Landfills may assess surcharges for items such as tires, mattresses, and appliances. When these charges apply, they are passed through at cost. To avoid delays and unexpected fees, disclose these items before loading.


8) Weight Allowance and Over-Tonnage

Many rentals include a weight allowance based on the dumpster size and typical debris types. If your load exceeds the included allowance, over-tonnage fees may apply. If you tell us your debris type up front (roofing, dirt, concrete, demolition), we can advise on the right size and how to reduce weight risk.


9) Damage, Indemnification, and Liability

You are responsible for damages caused by improper loading, moving the dumpster without authorization, site conditions not disclosed in advance, or third-party actions while the dumpster is on site. We are not responsible for damage resulting from hidden subsurface conditions (e.g., soft ground, voids, underground utilities) not disclosed prior to placement.

To the fullest extent permitted by law, you agree to indemnify and hold Kennedy Roll-Offs harmless from claims, damages, or expenses arising from prohibited materials, unsafe site access, or customer/third-party misuse of the dumpster.


10) Cancellations, Rescheduling, and Trip Charges

If you need to cancel or reschedule, contact dispatch as soon as possible. Fees may apply for late cancellations, failed delivery attempts, blocked access, or site conditions that prevent safe placement or pickup.


11) Payments

Payment terms are provided at booking and may vary by customer type (contractor account vs. residential). Past due balances may result in service holds. If applicable, you authorize us to charge approved payment methods for agreed services and valid additions described above.


12) Website Use

You agree not to misuse this website, attempt unauthorized access, or interfere with site operation. Content on this site is provided for general information and may change without notice.


13) Disclaimers

Services are provided “as is” and subject to practical operational constraints (routing, access, weather, landfill conditions). We do not guarantee specific arrival times or uninterrupted availability.


14) Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law rules. Any disputes will be handled in the appropriate courts located in Tennessee, unless otherwise required by law.
